Overview
Serbia grants temporary residence to foreigners who own an apartment or a residential building in their own name and live in it. The Law on Foreigners sets no minimum property value, and each permit runs for up to three years.
Eligibility depends on nationality. Individuals can buy a home only where Serbia has established reciprocity, which covers 84 countries including the United States, the United Kingdom, Canada and Australia. Government fees total RSD 23,880, and the notarized purchase contract is enough to file.
The catch is the property itself and the residence requirement. The home must be yours personally, you must live in it, and long absences break the continuity that permanent residence needs after three years.
Eligibility Requirements
Individuals can buy an apartment or residential building only where Serbia has established reciprocity with their country of citizenship. The Ministry of Justice list covers 84 countries, and the United States, United Kingdom, Netherlands and Japan also have treaty-based reciprocity. Estonia is the one EU member state missing from the list. The assessment follows citizenship, not residence, so dual nationals should buy under a listed citizenship.
Nationals of unlisted countries, including India, Bangladesh, Nigeria, the Philippines, Indonesia and North Macedonia, are not refused outright. Reciprocity is established case by case, so the answer has to be obtained before the contract is signed. A Serbian company can buy the home instead, but residence then rests on company ownership, not on the property.
Citizens of North Macedonia, Mongolia, Cyprus and Belarus pay only the submission fee for temporary residence, and passports of China, Armenia, Mali and Syria are exempt from the D visa fee.

Tax Information
How Serbia taxes property owners
Serbia treats you as a tax resident with permanent residence or a centre of vital interests in the country, or with 183 days of presence in a 12-month period that begins or ends in the tax year. Residents are taxed on worldwide income. Non-residents are taxed only on Serbian-source income, which includes rent from Serbian property and gains on its sale.
Personal income tax uses flat rates by category: 10% on employment and business income, 15% on dividends, interest and capital gains from private assets, and 20% on rental income, which falls to about 15% after a standard deduction. Gains on real estate are exempt after ten years of ownership. Non-residents pay 20% on the gain.
Buying costs 2.5% transfer tax on a resale home, or 10% VAT on a new build. Serbia levies no wealth tax on individuals.
What the IRS still requires
US citizens file a return on worldwide income wherever they live. The United States and Serbia have no income tax treaty and no totalization agreement, so neither double taxation nor social security contributions are coordinated.
The foreign earned income exclusion is $132,900 for tax year 2026, claimed on Form 2555. It covers wages and self-employment income only, not rent, dividends, capital gains or pensions. Rent and gains taxed in Serbia go through the foreign tax credit on Form 1116, and without a treaty, timing differences can leave some income taxed twice.
Foreign accounts that together exceed $10,000 at any point in the year require an FBAR. Form 8938 applies above $200,000 at year-end or $300,000 at any point for filers living abroad.

✦ 88Who qualifies
The ground applies to a foreign citizen who owns an apartment or a residential building in Serbia and lives in it. The Law on Foreigners sets no minimum property value, and land without a building does not qualify. A home held through a Serbian company does not count, because the company is the owner and the founder would apply on the company-formation ground instead.
Individuals can buy a home only where Serbia has reciprocity with their country. The list covers 84 countries, and the United States has treaty-based reciprocity. Ownership is shown with the notarized sale contract, so you can file before the Real Estate Cadastre registers the transfer.
Financial requirements
There is no income test. Applicants show means of subsistence, and the ministry accepts a statement of funds at the level of the minimum salary, proof of pension payments, an employment contract, or a certified guarantee from an employer or household member who has sufficient funds. The minimum wage for 2026 is RSD 371 net per working hour, which the government puts at RSD 64,554 a month.
Proof of health insurance is part of the filing. A private or international policy covering the stay meets it, and public coverage opens once you register for compulsory health insurance.
Application route
Nationals who need a visa first obtain a D visa on the ownership of real estate ground. Temporary residence must then be requested on the same basis as the visa. Americans can stay 90 days visa-free and file online during that stay.
The request goes through the Welcome to Serbia temporary residence page and the eForeigner portal, or in person at the police department for foreigners covering your registered address. Requests for minors are filed in person by their legal representatives. After approval you give biometric data at the police department, and the permit is issued as a biometric card.
Costs
- Submission fee: RSD 430.
- Approval of temporary residence: RSD 23,450.
- D visa where required: EUR 50.
Fees are paid at the last step of the portal form, and payments made outside the portal are not counted. Purchase costs sit on top: 2.5% transfer tax on a resale home or 10% VAT on a new build, plus notary and registration fees.
Permit duration and renewal
Each approval runs for up to three years, counted from the date of submission, and in practice many first permits are issued for 12 months. The extension request is filed no earlier than three months before expiry and no later than the expiry date, and a timely request keeps the stay lawful until the decision. The passport must stay valid for at least three months beyond the period requested.
The permit follows the ground. If the reason for the stay ends, for example through a sale of the home, you must contact the police department for foreigners.
Family members
Spouses, partners and children join through family reunification with a foreign citizen who holds approved temporary residence. When several foreigners buy one property and each applies on ownership, the home must be suitable for all of them to live in.
Presence and tax residency
You must live in the home. Over the three qualifying years, absences may total up to 10 months, or one absence may last up to six months, before continuity for permanent residence breaks. Spending 183 days in Serbia in a 12-month period also makes you a Serbian tax resident.
Path to permanent residence and citizenship
Permanent residence opens after three years of continuous temporary residence, and the request is filed in person at the police department from 60 days before the third year ends. It requires proof of ownership, such as a real estate deed excerpt, plus proof of means, health insurance, address registration and fees. Living abroad for more than a year in a row ends the right.
Permanent residents can apply for citizenship. Ordinary naturalisation requires renouncing the previous citizenship unless renunciation is legally impossible, so the realistic passport track is about six years from the first permit.
